Background

FAO is supporting the revision of a draft Land Code in Moldova. A preliminary analysis of issues has identified the need to examine in more detail the existent procedures of changing the purpose of use of agricultural land.

The procedure of changing the category of land use is ambiguous and very time consuming involving numerous permissions from various authorities who should act in a coordinated manner.

The procedure is described in article 34 of the draft Land Code. The decision is approved either by the administrative territorial unit of the second level, on the basis of the proposal made by the administrative-territorial unit of 1st level upon the owner's request (for agricultural land with natural fertility level up to 60 degrees and the surface of up to 5 hectares), or by the governmental decree at the recommendation of the administrative-territorial units of the second level upon the request of the owner (for agricultural land with natural fertility greater than 60 degrees or area greater than 5 hectares).

Under the supervision of the Senior Land Tenure Oficer, and in collaboration with ACSA and other project members, the consultant will undertake a detailed analysis of the administration of land use. The specific tasks are as follows:

  • Perform an in-depth analysis of the current framework and describe existing procedures, including in case of changes between different categories of land use, existing institutional arrangements, determininh roles and existing overlaps;
  • Conduct meetings with management of identified institutions responsible for land use planning and changes of land use;
  • Propose options seeking to simplify procedure and minimize time and bureaucracy, taking into account experience of other countries in the field, with indication of recommended option and relevant arguments for the recommended option;
  • Prepare a report on findings, delimitating what has to be included in the Land Code and what issues and aspects shall be included in other laws, regulations, etc.;
  • Participate in workshop to present findings and recommendations;
